Inter-state Rules of Transfer for IAS Officers

  1. The inter-state transfer of two IAS officers is possible only if two IAS officers are married. Under such circumstances, both persons should be a member of IAS (Indian Administrative Service) and must apply for cadre change stating the reason.
  2. In rare circumstances, some officers might get a transfer because of some suffering in certain areas. ‘The suffering’ for the inter-cadre transfer includes life threat to an IAS officer or their family member or critical health conditions of IAS officers or their family member due to the weather conditions of the state they are being transferred into.
  3. In case of threat to life or severe health conditions, the central government shall hold the originality of the request verified by an independent central agency or group of at least two independent experts.
  4. If the transfer request is genuine, the central government may send the officer for three years to a state in which they want to get transferred. The situation may be re-examined after three years, and if the situation remains tense, then the central government may permanently transfer the officer to the desired state.
  5. The inter-cadre transfer of IAS officers is not permitted in their home state.
  6. If the inter-cadre transfer is done based on marriage, the government ensures that the cadre of one officer accepts another officer.
  7. If both the states are reluctant to provide inter-cadre transfer, then the government of India issues a third cadre for the couple.

Deputation of Cadre Officers

  1. Cadre officers are designated under the central government or another state government or through a body of individuals. The committee is subject to any disagreement between the company and the officials. In such a scenario, the central government and the concerned state government will make a decision.
  2. Another provision of the deputation is that cadres and officials can also be appointed to serve in companies, associations, or individual groups (whether established or not). Whether registered or not, these groups are wholly or significantly owned by the state government, company, municipal or local government.

Posting of Cadre Officers

  1. All deputations and appointments to the cadre posts are made by the State Government in the event of state cadre. In the event of a joint cadre, it’s made by the concerned State Government.
  2. In discussion with the state governments, the central government fixed the term of the cadre posts concerned in item 1 of the schedule to IAS (Indian Administrative Services) Fixation of cadre strength regulation 1955.
  3. A cadre officer shall possess the minimum tenure as authorized except in some conditions. For instance, in the event of promotion, retirement, deputation outside the state, or training that lasts for more than two months.
  4. Pursuing the recommendation of a committee on minimum tenure, an officer may be relocated before the minimum prescribed tenure, based on the schedule taken over by the rules.
  5. The central government can send a cadre officer to an ex-cadre post while the central government’s consent remains valid.
  6. A person who is not a cadre officer cannot acquire a cadre post in a state unless there is no suitable cadre officer found for the post or if the vacancy lasts for more than three months.
  7. The state government should have prior permission of the central government for placing the individual who is not a cadre officer for more than three month period.
  8. No cadre posts shall be held vacant or in suspension for more than six months without the central government’s consent.
