Central Administrative Tribunal (was set up in 1985) is a multi-member body consisting of a chairman and members. 1. With the amendment in the Administrative Tribunals Act, 1985 in 2006, the members have been given the status of judges of High Courts. 2. They are drawn from both judicial and administrative streams and are appointed by the president. 3. They hold office for a term of five years or until they attain the age of 65 years, in the case of chairman and 62 years in case of members, whichever is earlier. 4. It is not bound by the procedure laid down in the Civil Procedure Code of 1908. It is guided by the principles of natural justice. Natural justice implies fairness, reasonableness, equity, and equality. Natural justice is the concept of common law and it is the common-law world counterpart of the American ‘procedural due process’. In India, the principles of natural justice are firmly grounded in Article 14 and Article 21 of the Constitution. Principles of natural justice are attracted whenever a person suffers a civil consequence or prejudice is caused to him in any administrative action. Hence Option (b) is correct.
