Union Public Service Commission (UPSC) is an important recruiting agency for the Government of India. UPSC in Which Article?

Article 315-323 can be found in part XIV of the Indian Constitution. It talks about the establishment of the Public Service Commission for the Union and a Public Service Commission for each state.

UPSC Article 315

This Interstate Council Article states the need and provisions for a Public Service Commission for the Union and the State. If two or more States agree that there is a need for one common Public Service Commission amongst them, and if a clear approval for the cause is passed by the House then the Parliament may by law provide for the appointment of a Joint State Public Service Commission to serve the needs of those States.

Appointment and Term of Office of Members – Article 316

As per Article 316, the Chairman and other members of Union Public Service Commission are appointed by the President of India. In case due to certain problems if a situation arises where the office of the Chairman becomes vacant his duties are performed by one of the other members who the President appoints for the purpose.

A member holds office for a term of six years from the date of appointment into the office or until he attains the age of sixty-five years, whichever is earlier.

Removal and Suspension of a Member of a Public Service Commission – Article 317

Reasons for the President to order the removal from office the Chairman or any other member of a Public Service Commission are:

  • The Member is adjudged to be an insolvent
  • Engages during his/ her term of office in any paid employment outside the duties of his office
  • In the opinion of the President, the member is not fit to continue in office by reason of infirmity of mind or body.

Power to Make Regulations as to Conditions of Service of Members and Staff of the Commission – Article 318

The President and the Governor of the State in most cases are the ones who determine the number of members and their conditions of service, and make provisions accordingly for them, provided that the conditions of service of a member of a Public Service Commission shall not be varied to his disadvantage after his appointment.

Prohibition as to the Holding of Offices by Members of the Commission on Ceasing to be Such Members – Article 319

On ceasing to hold office-

  • The Chairman of the Union Public Service Commission shall be ineligible for further employment either under the Government of India or under the Government of a State.

  • The Chairman of a State Public Service Commission shall be eligible for appointment as the Chairman or any other member of the Union Public Service Commission or as the Chairman of any other State Public Service Commission, but not for any other employment either under the Government of India or under the Government of a State.

  • A member other than the Chairman of any Public Service Commission is eligible for appointment into any office above their previous station only.

Functions – Article 320

The Article states that it is the duty of the Union and the State Public Service Commissions to conduct examinations for appointments to the services of the Union and the services of the State respectively. The Union Public Service Commission or the State Public Service Commission is to be consulted on all matters regarding recruitment to civil services and for civil posts and more.

Power to Extend Functions – Article 321

Additional functions by the Union Public Service Commission or the State Public Service Commission for the services of the Union or the State and also the services of any local authority or other body corporate constituted by law or of any public institution may be assigned by the Parliament.

Expenses – Article 322

The expenses of the Union or a State Public Service Commission, including any salaries, allowances, and pensions are taken into account in the Consolidated Fund of India.

Reports – Article 323

The Union Commission has to present annually to the President a report as to the work done by the Commission.

UPSC Article 263
